CONSENT FOR THE PROCESSING AND USE OF PERSONAL INFORMATION

IN TERMS OF THE PROTECTION OF PERSONAL INFORMATION ACT 4 OF 2013 (POPIA)

1. Introduction

1.1 Ballet Pretoria is a dance studio providing dance classes, examinations, performances, and related dance activities to students.

1.2 In the ordinary course of its operations, Ballet Pretoria collects, stores, uses, processes, transfers, retains, and manages personal information of students and parents/guardians.

1.3 To comply with the Protection of Personal Information Act 4 of 2013 (POPIA), Ballet Pretoria requires the express and informed consent of parents/guardians and/or students to process personal information.

1.4 By registering with Ballet Pretoria and signing the registration and Terms & Conditions, I consent to the processing of my personal information and that of my minor and/or dependent child/children.

2. Purpose of Processing

2.1 I consent to Ballet Pretoria collecting and processing personal information for purposes directly related to:

•Registration and enrolment;

•The provision of dance classes, rehearsals, performances, exams, festivals, and competitions;

•Communication with parents/guardians;

•Administration, billing, and fee collection;

•Compliance with legal and contractual obligations;

•Safety, security, and record-keeping.

2.2 I consent to Ballet Pretoria sharing relevant personal information with:

•Dance examination bodies;

•Dance competition and festival organisers;

•Contracted service providers (including administrative, accounting, or IT services),

only where necessary for the provision of services outlined in the Terms & Conditions.

2.3 I understand that without this consent, Ballet Pretoria will be unable to:

•Register my child for classes;

•Enter my child for exams, competitions, or performances;

•Provide the services described in the signed Terms & Conditions.

3. Withholding or Withdrawal of Consent

3.1 I understand that I may withhold or withdraw my consent for the processing of personal information at any time by submitting written notice to Ballet Pretoria.

3.2 I acknowledge that withholding or withdrawing consent may result in:

•The discontinuation of dance classes;

•Inability to participate in exams, competitions, or performances;

•Termination of the contractual relationship, in line with the Terms & Conditions.

3.3 Any processing lawfully carried out prior to withdrawal of consent will remain valid.

4. Storage and Security of Personal Information

4.1 Ballet Pretoria will store personal information in a secure environment and will take reasonable technical and organisational measures to protect such information against loss, damage, unauthorised access, or unlawful processing.

4.2 Personal information may be stored in physical and/or electronic form.

5. Retention of Personal Information

5.1 Ballet Pretoria will retain personal information only for as long as necessary to fulfil the purposes for which it was collected and as required by law.

5.2 Personal information may be retained after termination of registration where:

•Required or authorised by law;

•Necessary for contractual, administrative, or legal purposes (including debt collection);

•Required under the Terms & Conditions agreed to by the parent/guardian.

6. Intended Recipients of Personal Information

6.1 The intended recipients of personal information include:

•Ballet Pretoria’s teachers and administrative staff;

•Relevant dance examination boards and competition organisers;

•Third-party service providers where necessary.

6.2 All disclosures will be subject to confidentiality obligations and POPIA-compliant safeguards.

7.1 I understand that I have the right to:

•Have my personal information processed lawfully and reasonably;

•Request access to my personal information held by Ballet Pretoria;

•Request correction or deletion of inaccurate, outdated, or misleading information;

•Object to the processing of my personal information on reasonable grounds.

7.2 Requests must be submitted in writing to Ballet Pretoria.

7.3 I acknowledge that failure to keep my contact and personal details updated may result in missed communication, and Ballet Pretoria will not be held liable for consequences arising from outdated information, as stated in the Terms & Conditions.

8.1 Ballet Pretoria will not sell or distribute personal information to third parties for marketing purposes.

8.2 Personal information may be used for communication related to:

•Class schedules;

•Events, exams, and performances;

•Administrative notices;

•WhatsApp groups used for official studio communication, as outlined in the Terms & Conditions.

9. Limitation of Liability

9.1 I agree that:

•Ballet Pretoria will not be held liable for any direct or indirect loss arising from the lawful processing of personal information;

•Ballet Pretoria will not be liable for any misuse of personal information by third-party dance organisations to whom information was lawfully supplied;

•This consent forms part of the overall contractual agreement governed by the signed Terms & Conditions.

10. Consent on Behalf of Dependents

10.1 I confirm that I am the legal parent/guardian of the student(s) listed on the registration form or otherwise authorised to give consent on their behalf.

10.2 I indemnify Ballet Pretoria against any claims arising from consent given without proper authority.

11.1 I confirm that:

•I have read and understood this consent document;

•I had the opportunity to ask questions;

•My consent is given freely, voluntarily, and without any undue influence.

DEFINITIONS

Definitions used in this consent document shall have the same meaning as those set out in the Protection of Personal Information Act 4 of 2013 (POPIA), including but not limited to the definitions of “Personal Information,” “Processing,” and “Record.”
